Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by Durum Records, including booking support for artists, events and festival organization, vinyl publishing, online sales of merchandise and music, and community membership offerings. By engaging with our services, making purchases, or subscribing to a membership, you agree to be bound by these Terms.

1. Eligibility and General Use

  • You must be at least 18 years old and legally capable of entering into binding agreements to use our services or become a member.
  • By working with or purchasing from Durum Records, you agree to comply with applicable laws and these Terms.
  • We may update or amend these Terms from time to time. Continued use of our services constitutes acceptance of any changes.

2. Artist Services

Booking Support

Durum Records supports artists by liaising with venues, festivals, and promoters. While we do our best to secure opportunities, we cannot guarantee specific bookings, performance outcomes, or audience numbers.

Vinyl Publishing & Marketing Rights

  • We support artists in the production and physical distribution of  their music (e.g. Vinyl, CD, Casette).
  • Unless agreed otherwise in writing, Durum Records retains the right to use digital and physical content (such as music clips, artwork, and video materials) for promotional and marketing purposes related to the artist’s release.
  • Ownership of master recordings, compositions, and royalties will be subject to separate written agreements with each artist.

3. Events & Festivals

  • Durum Records organizes cultural events, including the Falafelpop Festival.
  • Ticket purchases are binding and non-refundable, except where required by law (e.g., cancellation of the event).

Attendees are responsible for their own safety, and must comply with venue and festival rules. We reserve the right to deny entry or remove individuals for unsafe, unlawful, or disruptive behavior.

4. Webshop (Merchandise & Vinyl Sales)

  • Products sold via our webshop (including vinyl and merchandise) are subject to availability.
  • Prices include VAT where applicable and are stated in euros. Shipping costs are displayed at checkout.
  • Customers have a statutory right of withdrawal of 14 days after receipt of goods, provided items are returned in their original condition. Digital downloads and custom/personalized items are non-refundable.
  • Risk of loss or damage passes to the customer upon delivery.

5. Community Memberships

Durum Records offers subscription-based memberships with perks such as discounts, exclusive content, and free products. Details of each package are described on our website.

Membership

  • Memberships are personal and non-transferable.
  • Benefits may evolve over time; we will notify you of significant changes where possible.

Fees and Payment

  • Membership fees must be paid in full and in advance (monthly or annually, depending on the plan).
  • If payment fails, we may suspend or cancel membership access.

Cancellation

  • You may cancel your membership at any time via written notice or through your account settings. Cancellation takes effect at the end of your current billing period.
  • We reserve the right to suspend or terminate membership for violation of these Terms.

6. Intellectual Property

  • All rights in the Durum Records name, logo, designs, and website content belong to Durum Records.
  • You may not use our intellectual property without prior written permission.
  • Artists retain ownership of their creative works unless otherwise agreed by contract.

7. Limitation of Liability

  • To the fullest extent permitted by law, Durum Records is not liable for indirect, incidental, or consequential damages arising from the use of our services, including lost profits, business interruption, or data loss.
  • We do not guarantee uninterrupted access to our website, webshop, or events.

8. Indemnification

You agree to indemnify and hold harmless Durum Records, its partners, employees, and affiliates against claims, damages, or expenses arising from:
(a) your breach of these Terms,
(b) your misuse of our services,
(c) your violation of third-party rights (including intellectual property or privacy).

9. Privacy

We respect your privacy and handle personal data in accordance with the GDPR. Our Privacy Policy explains how we collect, use, and protect your data. By using our services, you consent to this processing.

10. Governing Law & Jurisdiction

These Terms are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law requires otherwise.
